What happened
On September 29, 2026, USCIS announced new fees for the EB-5 immigrant investor program. The final rule was published in the Federal Register on September 30, 2026 and takes effect on November 30, 2026. It finalizes a proposal from October 2025.
USCIS says the new fees are designed to fully recover the cost of running the EB-5 program, meet the processing time goals in the EB-5 Reform and Integrity Act of 2022, and pay for integrity work such as audits and site visits. DHS estimates EB-5 costs at about $105 million a year, against about $56.6 million in revenue at current fees.

The I-526 and initial I-526E fees include a new $75 EB-5 technology fee. The EB-5 Integrity Fund fee paid with each I-526E rises 10% for inflation, from $1,000 to $1,100. The annual regional center integrity fee rises from $10,000 to $11,000 for centers with 20 or fewer investors, and from $20,000 to $22,000 for larger ones.
Who is affected
Anyone filing an EB-5 petition or application postmarked on or after November 30, 2026. Today, under the current fee schedule, the I-526 and I-526E cost $3,675 and the I-829 costs $3,750. That means the investor petition roughly doubles in price.
What it means for your move
The required investment amounts do not change: $1,050,000, or $800,000 in a targeted employment area or for an infrastructure project. Fees are a small part of the total cost, but the increase is significant for families planning the EB-5 route. Investors already holding conditional green cards will pay the higher I-829 fee if they file on or after November 30.
What to do now
- If your I-526E package is nearly ready, filing before November 30, 2026 keeps the current fee.
- If your I-829 filing window is open, check whether you can file before the change.
- Confirm the exact amount on Form G-1055 on uscis.gov before you pay. A wrong fee leads to rejection.
- Work with a licensed immigration attorney and check that the regional center and project are in good standing.
What happens next
