UK Lets Modern Slavery Victims on Skilled Worker Visas Work for Any Employer

From October 2026, Skilled Worker visa holders formally recognised as modern slavery victims can leave an abusive sponsor and work for any employer.

What happened

On 9 October 2026 the Home Office announced that Skilled Worker visa holders whom it formally recognises as victims of modern slavery are no longer tied to their sponsor. They can take other lawful work for the rest of their visa.

The change comes from Statement of Changes HC 584, laid on 3 September 2026, which lists 8 October 2026 as the start date. The new rule (SW 18.3) covers a worker who has been referred into the National Referral Mechanism and received a positive Conclusive Grounds decision during their most recent permission. Work as a professional sportsperson, including sports coaching, is still excluded.

Who is affected

The change covers sponsored workers who have been exploited by their employer. The Home Office gave the example of a care worker who paid an agency £20,000 for a job. Her sponsor then demanded £400 a month to keep her visa active and paid her £200 to £300 a month.

Before this change, a victim who left an abusive sponsor risked losing both their status and their income, because Skilled Worker visa holders cannot claim public funds.

What it means for your move

The rule does not create a new visa or a new route to settlement. It lifts the usual condition that a Skilled Worker may only do the job their sponsor has certified. The victim keeps their current permission and can work for any employer until it ends. To extend later, or to build towards indefinite leave to remain, they will normally still need a new sponsor and a new Skilled Worker application under the usual rules.

The Home Office says that more than 6,600 sponsors have lost their licence since the current government took office, including over 4,400 in the year ending June 2026, the highest number on record.

What to do now

  • If your employer is charging you to keep your visa, holding back pay or not giving you the hours promised, contact the Modern Slavery Helpline or the police. Only designated “first responder” organisations can refer you into the National Referral Mechanism.
  • Keep records: payslips, bank statements, messages and any payments made to agents or sponsors.
  • Get advice from a regulated immigration adviser or solicitor before you leave your job, so that you understand how a referral affects your permission.

What happens next

The Home Office says that sponsors will be referred to the police where criminality is found. The Immigration White Paper also commits to making it easier for sponsored workers to change employer more generally, but no further rules have been published.
